In this civil appeal, the Supreme Court addressed the wrongful exclusion of a candidate from the Kerala Higher Judicial Service selection process due to an illegal grant of moderation of marks to other candidates. The Court held that the appellant, having participated in the common selection process, was entitled to be placed on the revised select list and awarded notional seniority from the date other candidates selected in the same process were appointed. The Court rejected the contention that procedural delays could defeat the appellant's substantive rights to equitable treatment and seniority."
