Supreme Court of India 2017-03-31 remanded

C.R. Yadav, HCS (Retd) vs State of Haryana and Ors

Bench: 2 — Kurian

In Brief

A High Court was asked to reconsider its rejection of a seniority dispute writ petition that had been filed before the appellant's retirement in 2000. The petition, originally filed in 1993, had been pending for over 23 years when the High Court dismissed it solely on the ground that the appellant had retired. The Supreme Court held that retirement does not make a pending seniority dispute writ petition infructuous. The Court set aside the High Court's judgment and remitted the case for decision on merits, requesting expeditious disposal within six months as the appellant is elderly."
