Supreme Court of India 2017-07-17 remanded

Hriday Shankar Tiwari vs District Co-operative Bank Ltd. & Ors

Bench: 2 — Kurian

In Brief

The Supreme Court set aside the High Court's summary dismissal of a writ petition filed by a bank employee challenging his termination dated 2 August 2000. The High Court had dismissed the petition in a brief order without hearing the appellant or considering his submissions for reinstatement and arrears. The Supreme Court held that natural justice requires the High Court to afford a fair opportunity of hearing before deciding such matters. The appeal was disposed of by remitting the writ petition to the High Court for fresh disposal after hearing the appellant.
