Campaign for Judicial Accountability and Reforms vs Union of India and Others

Bench: 3 — <UNKNOWN>

In Brief

Campaign for Judicial Accountability and Reforms filed a writ petition seeking a Special Investigation Team headed by a retired Chief Justice to investigate an alleged conspiracy involving bribery in a matter pending before the Supreme Court. The petitioner sought direction to the CBI to hand over evidence to the proposed SIT. The Supreme Court dismissed the petition, finding it wholly frivolous, contemptuous, and an abuse of process. The Court held that the FIR was against a retired Judge and private persons, not sitting judges, and that under established law (K. Veeraswami), no FIR against sitting judges can proceed without the Chief Justice's consultation. The petition was identical to a previously dismissed petition (Kamini Jaiswal), constituting abuse of court's process, and cost of Rs 25 lakhs was imposed.
