Canara Bank challenged the High Court's decision quashing disciplinary proceedings initiated against a retired Assistant General Manager. The Bank served a charge-sheet after the employee superannuated in May 2007. The Supreme Court held that Regulation 20(3)(iii) of the Bank's Service Regulations permits disciplinary proceedings to continue after retirement only if the charge-sheet was served before superannuation. Since the charge-sheet was issued after retirement, it could not be validly initiated. The Court affirmed the High Court's order quashing the proceedings and dismissed the Bank's appeal, establishing that disciplinary action against a retired employee is impermissible unless proceedings were formally commenced before retirement.
