A State Bank of India officer with extended service ending on 01.10.2010 challenged his dismissal following a disciplinary proceeding. The Supreme Court held that the chargesheet initiating the disciplinary process was issued on 18.03.2011—after his extended service expired—making the proceedings wholly without jurisdiction. Although a legal fiction under service rules can continue a proceeding initiated before superannuation, it cannot grant jurisdiction to initiate proceedings post-superannuation. The disciplinary order was void ab initio. The Court dismissed the bank's appeal and directed release of all service dues.
