Central Bank of India vs Husainy Fakhruddin and Others

Bench: 2 — Kurian

In Brief

Central Bank of India appealed against a High Court judgment ordering it to release deposits made by four respondents that had been frozen at the CBI's request during a criminal investigation. The CBI subsequently withdrew its freeze directive and stated it had no objection to releasing the funds. The Supreme Court, finding that the primary obstacle to release had been removed through CBI's withdrawal, disposed of the appeal by directing the Bank to release the deposits within one week, leaving open any other independent grounds for withholding them and declining to address the Bank's other legal contentions.
