This case concerns the CBI's challenge to Kerala High Court orders granting anticipatory bail to 18 accused persons—mostly police and intelligence officials—in the ISRO espionage case (Crime No. 225/1994). The FIR was filed in 2021 on recommendations of a Supreme Court-appointed Committee and following the Court's 2018 judgment directing remedial action. The Supreme Court held that while the High Court correctly recognized the delay, it failed to examine the allegations, roles, and positions of individual accused or the special context that the FIR flowed from Court directions. The judgment was set aside and remanded for the High Court to reconsider afresh on merits, without being influenced by the delay factor alone."
