The Central Provident Fund Commissioner challenged the rejection of its application to reject the respondent's suit under Order VII, Rule 11 of the Civil Procedure Code. The respondent claimed procedural violations under the Employees Provident Funds Act. The Supreme Court held that a plaint disclosing a cause of action cannot be summarily rejected merely because of alleged procedural defects. While rejection under Order VII, Rule 11 is limited to examining the pleadings alone, a court may raise a preliminary issue on maintainability (which permits full examination of documents) before trial. The Court allowed the appellant to raise a preliminary maintainability issue before the trial court."
