Central Public Information Officer, SCI & Anr vs Subhash Chandra Agarwal

Bench: 3 — <UNKNOWN>, <UNKNOWN>, <UNKNOWN>

In Brief

A Public Information Officer and another challenged an order requiring disclosure of information about Supreme Court judges under the Right to Information Act, 2005. The petitioner claimed that disclosing such information would compromise judicial independence and interfere with judges' freedom to express candid opinions. The three-judge bench agreed that the case raised substantial constitutional questions about whether the judiciary's independence requires exempting judicial information from disclosure under Section 8(i)(j) of the RTI Act. Rather than deciding these issues, the Court referred the matter to a Constitution Bench for authoritative determination of the constitutional principles at stake.
