The Supreme Court dismissed the appeal of Chaitra Nagammanavar, who was appointed as an Assistant Professor at Bangalore University. The university had advertised that the mode of selection for this backlog-reserved position would follow the 2001 Special Recruitment Rules, which prefer candidates aged 29-40 years. Although Nagammanavar was more meritorious, she fell outside this age bracket. The respondent, also an ST candidate within the preferred age bracket, challenged her appointment. The Court held that universities must comply with the 2001 Rules when specifically declared in advertisements, and the State Government's repeated directives mandated compliance. Respondent no. 7 was entitled to the appointment. The Court observed that the university should consider a supernumerary post for Nagammanavar due to the university's negligent conduct.
