Chandra Mohan Varma vs State of Uttar Pradesh & Ors

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

Chandra Mohan Varma, a government employee, sought mandamus to continue in service beyond his superannuation age of 60 years under a 2015 government notification raising the retirement age to 65 years. The Supreme Court held that he was not entitled to this benefit because he had already attained the age of superannuation (60) when the notification was issued. The Court ruled that retirement age enhancements apply only to employees who have not yet reached the earlier retirement age at the time of the notification's issue. His terminal benefits were ordered computed under the original retirement rules within two months. The appeals were dismissed with no order as to costs."
