Chandrasekar and another vs State

Bench: 2 — Navin Sinha

In Brief

The appellants were convicted under Section 302 IPC for murdering the deceased and assaulting an injured witness. They came armed in a car and repeatedly assaulted the deceased on the head with a hammer, sickle, and iron rod. The Supreme Court upheld their conviction, holding that the eye-witness testimony of the injured witness (PW-1) was reliable and credible, with in-built guarantee of presence and truthfulness. The relationship by marriage did not disqualify the testimony. The utterances of the appellants before the assault and the merciless repeated blows to the head demonstrated murderous intention. The Court rejected arguments about missing injury reports and land disputes as immaterial. The appeals were dismissed.
