The appellant purchased the disputed property from Sonaji through sale deeds dated 1974 and 1978, and sought to prevent the respondent Trust from excavating it. The respondent Trust, however, claimed title based on an earlier gift deed from Sonaji dated 1973. The Supreme Court upheld the gift deed as valid, finding that Sonaji never denied its execution or possession delivery, and that it was properly proved by witnesses. The Court held that the earlier gift deed superseded the later sale deeds, and that the Trust's suit for declaration of ownership and possession was maintainable. The appeals were dismissed and the respondent Trust's title confirmed.
