N. THAJUDEEN vs TAMIL NADU KHADI AND VILLAGE

Bench: 2 — Pankaj Mithal, Ujjal Bhuyan

In Brief

Tamil Nadu Khadi and Village Industries Board received a gift deed for land in 1983, which it accepted and acted upon. The donor later attempted revocation in 1987. The Board filed suit in 1991 seeking declaration of title and recovery of possession. The trial court dismissed it as barred by limitation, but appellate courts reversed this. The Supreme Court held that the gift deed was validly executed, accepted, and acted upon, and could not be revoked as the donor had reserved no revocation right. The Court also held that for combined suits of declaration and possession recovery, the 12-year limitation for possession applies, not the 3-year limit for declaration alone. The appeal was dismissed.
