Two criminal appeals challenged the quashing of complaints under the Insecticides Act, 1968. In the first appeal, the Supreme Court held that a complaint filed on 25.03.2014 was barred by limitation, as the three-year period commenced from the first analysis report on 14.03.2011, not from a subsequent report. The complaint was quashed. In the second appeal, the Court held that a Managing Director could not be prosecuted when the company had designated a specific responsible officer for quality control through Board resolution and undertaking. The complaint was partly allowed by quashing the proceedings against the Managing Director, but upheld against the company itself.
