The Supreme Court examined two related criminal appeals concerning prosecution under the Insecticides Act, 1968 for allegedly selling misbranded insecticides. In one case, the Court held that the complaint was barred by limitation as the three-year period commenced from the first conclusive laboratory report (14 March 2011), not a later confirmatory report requested by the accused. In the second case, the Court partly allowed the appeal by quashing proceedings against the Managing Director, holding that when a company has formally delegated quality control responsibility to a specific officer through a documented resolution and undertaking, vague allegations against the Managing Director are insufficient without categorical proof of his personal involvement or negligence.
