Chief Manager, Punjab National Bank & Anr vs Anit Kumar Das

Bench: 3 — <UNKNOWN>, <UNKNOWN>, <UNKNOWN>

In Brief

Punjab National Bank challenged a High Court order directing it to allow a respondent to resume duties as a Peon despite suppression of material information in his application. The respondent had failed to disclose that he was a graduate, contrary to the educational eligibility criteria prescribed in the recruitment circular. The Supreme Court allowed the Bank's appeal, holding that a candidate who deliberately suppresses material facts or provides false information cannot claim continuance in service. The Bank was entitled to enforce its prescribed eligibility criteria and cancel the candidature based on this suppression and misrepresentation.
