Chief Manager, Punjab National Bank & Anr vs Anit Kumar Das

Bench: 3 — Ashok Bhushan, R. Subhash Reddy, M. R. Shah

In Brief

Punjab National Bank challenged a High Court order directing it to appoint a candidate as a Peon despite his ineligibility. The candidate held a graduate degree but did not disclose this in his application, even though the job advertisement explicitly stated graduates were not eligible. The Supreme Court held that employers may prescribe qualifications based on institutional needs, and candidates who accept recruitment terms cannot later challenge eligibility criteria. Critically, the candidate's deliberate suppression of his graduate status constituted grounds for cancellation of appointment, as it reflected on his character. The Court allowed the bank's appeal and quashed the High Court orders, finding the suppression of material information was a serious matter independent of ineligibility grounds."}
