An auction purchaser challenged the High Court's decision to set aside a property sale in execution proceedings on the ground of irregularities in notice and publicity. The Supreme Court held that setting aside an auction sale requires proof of both a material irregularity and substantial injury resulting from it. The Court found that adequate publicity had been given through newspapers and beat of drums, resulting in seven bidders' participation, and that the 15-day notice was properly calculated. Since none of the judgment debtor's objections constituted material irregularities causing substantial injury, the Court restored the executing court's order upholding the sale.
