The Supreme Court dismissed an appeal by legal representatives of a judgment-debtor challenging the confirmation of an execution auction sale spanning fifty years and multiple rounds of litigation. The appellants claimed the executing court violated Order XXI, Rule 64 by selling the entire 17-decimal property instead of only the portion necessary to satisfy a Rs. 3,000 decree. The Court held the objection was barred as it should have been raised earlier and was now time-barred. The sale had already become absolute, a sale certificate issued, and possession delivered. The Court applied res judicata principles and declined to reopen the execution on technical grounds at such a late stage.
