Chitra Sharma and others vs Union of India and others

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

In a dispute over insolvency proceedings against Jaypee Infratech Ltd., the Supreme Court modified its earlier stay order. The Court directed that the Interim Resolution Professional take immediate management control to protect all stakeholders, particularly home buyers from lower and middle income groups who had invested their savings. The Court appointed counsel to represent home buyers' interests in creditor meetings and required the holding company to deposit Rs. 2,000 crores. Directors and promoters were barred from leaving India without permission. The Court balanced statutory requirements of the Insolvency Code with the urgent need to protect vulnerable home buyers' interests during the restructuring process."
