Supreme Court of India 2016-03-08 dismissed

Commissioner of Central Excise & Customs vs Mahindra & Mahindra Ltd

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

The Supreme Court dismissed Revenue's appeal challenging the Tribunal's decision on excise duty valuation. The question was whether bullet-proofing costs applied to vehicles after factory clearance should be added to the transaction value for excise duty. The Court held that since vehicles were cleared from the factory without bullet-proofing, and the bullet-proofing was performed by external workers after clearance, such post-clearance costs could not be added to the transaction value. Excise duty must be calculated on the value of goods at the point of factory clearance.
