Oriental Insurance Company appealed against an award made by a Motor Accident Claims Tribunal, challenging the enhancement of compensation granted to an injured person. The insurer argued contributory negligence by the owner of a parked vehicle, sought reduction in the additional 30% enhancement, and challenged the interest rate. The Supreme Court held that the insurer should have impleaded the relevant parties before the Tribunal and could not raise such defences afterwards. The Court upheld the 30% additional enhancement as justified by the permanent nature of the injury. The interest rate was reduced to 8% on the peculiar facts of the case.
