In Brief
The Court decided whether bottling liquefied petroleum gas (LPG) into cylinders qualifies as 'production' or 'manufacture' under the Income Tax Act, 1961, to claim tax deductions. The Assessing Officer argued that since LPG's chemical composition doesn't change, bottling is not manufacture. The Court held that 'production' is wider than 'manufacture' and includes activities creating commercially distinct, marketable products. Bottling LPG involves complex processes (compression, liquefaction, safety mechanisms) rendering it usable for domestic consumers. This transformative process constitutes 'production', entitling the assessees to tax deductions under Sections 80HH, 80-I and 80-IA. The appeals were dismissed.
