Supreme Court of India 2017-11-01 dismissed

Commissioner of Income Tax and Anr vs Deutsche Sotware Ltd

Bench: 2 — Rohinton Fali Nariman

In Brief

The Supreme Court dismissed multiple Special Leave Petitions filed by the Commissioner of Income Tax challenging a High Court judgment in an income tax appeal. While finding no substantive infirmity in the High Court's decision, the Court agreed with the Department's challenge regarding paragraph 10 of that judgment, which had imposed costs of Rs. 1 lakh against the Department. The Court held this cost imposition to be unfair and uncalled for, and accordingly expunged paragraph 10. Two matters were listed for further hearing.
