Commissioner of Income Tax, Panaji vs Automobile Corp. of Goa Ltd

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

The Revenue filed tax appeals and review petitions before the High Court, but the High Court dismissed them on the sole ground that the tax demand was less than Rs. 2,00,000/-. The Supreme Court set aside both High Court orders and remitted the case for fresh consideration on merits. The Court held that review petitions are maintainable against Section 260A orders and that the assessment must consider the notional tax effect. The appeals were allowed and the matters sent back to the High Court for proper adjudication.
