In Brief
The Revenue challenged the High Court's dismissal of its appeal in an income tax matter arising from a search operation. The Supreme Court allowed the appeal and remanded the case, finding the High Court's judgment legally flawed. Although the High Court heard both parties, it failed to frame substantial questions of law or provide reasoned analysis for dismissing the appeal—merely stating "in view of the above" without prior discussion. The Court held that appellate judgments on merits must contain grounds and reasons supporting their conclusions, not just the conclusion itself. The High Court's failure to comply with Section 260A(4) and (5) requirements rendered the order unsustainable.
