Commissioner of Income Tax vs Vasisth Chay Vyapar Ltd

Bench: 2 — Rohinton Fali Nariman

In Brief

The Supreme Court dismissed multiple consolidated civil appeals filed by the Commissioner of Income Tax against Vasisth Chay Vyapar Ltd and related parties. The Court found that the High Court had provided full and meaningful reasoning for its decision and agreed with that reasoning. However, in one case (Civil Appeal No. 998 of 2013), the Court permitted a review petition before the High Court as the appellant contended that the High Court had erroneously treated his case as having different facts when the facts were similar to all other cases. The review petition had to be filed within four weeks.
