A woman appointed as Road Gang Mazdoor sought appointment to higher posts (Overseer, Revenue Assistant, and Town Planning Inspector) based on her Diploma in Civil Engineering qualification. The High Court repeatedly directed her consideration for appointment. The Supreme Court held that educational qualifications alone do not entitle a person to a public post. Appointments must follow applicable recruitment rules made under Article 309 of the Constitution. The High Court lacked authority to direct appointment to posts where the person did not fall within the prescribed feeder cadre. The Court set aside the High Court order, holding it was patently illegal and without legal basis.
