Committee of Management (Alleged) Shibli National Inter College, Azamgarh vs Shah Basit Jahid and Ors

Bench: 3 — Dipak Misra, A.M. Khanwilkar, Mohan M. Shantanagoudar

In Brief

The Supreme Court resolved a dispute over elections to the Committee of Management of Shibli National Inter College and affiliated institutions in Azamgarh. After the High Court set aside earlier elections, the Court directed that 627 members found validly inducted by the Assistant Registrar of Societies be treated as final voters. These members must clear any society arrears within six weeks, after which fresh elections shall be held for the Society's Committee and subsequently for the college committees, all as per by-laws. The previous Committee may continue till then. The Court partly allowed the appeal, modifying the High Court's order to ensure finality and prevent perpetual election litigation.
