Committee of Management (Alleged) Shibli National Inter College, Azamgarh vs Shah Basit Jahid and Ors

Bench: 3 — Dipak Misra, A.M. Khanwilkar, Mohan M. Shantanagoudar

In Brief

The Supreme Court clarified procedures for conducting elections to the Committee of Management of Shibli National Inter College, Azamgarh. The High Court had set aside elections without determining which of 627 allegedly inducted members were valid voters. The Court held that valid induction must first be finalized, then used as the electoral college. The Court permitted the current Committee to continue temporarily and issued directions for fresh elections within twelve weeks (six weeks to clear arrears, six weeks for elections). The High Court's order was modified; the Court also admonished respondents for abusing election litigation to prevent finality and directed that future election disputes be raised only in appropriate forums, not higher courts."
