Commodore P.K. Banerjee challenged the Armed Forces Tribunal's rejection of his plea that uncommunicated adverse remarks in his 2008 ACR for commanding INS Tabar had a cascading effect on subsequent ACRs, denying him promotion to Rear Admiral. The Supreme Court upheld the AFT's decision. While the adverse remarks were rightly expunged, the court found they had no cascading effect on later reports by different officers. The court validated the Navy's PARB system allowing moderation of grades to reflect overall career profile. The appellant's claim of being ranked No. 1 in 2007 was factually incorrect. The court dismissed the appeal but, recognizing the appellant's competence and service contributions, hoped the Navy would grant him due promotion in his turn without further delay."
