Compack Enterprises India held the ground floor of a Delhi industrial property under a license agreement that expired in September 2008. After the tenant remained in possession unlawfully, the owner sued for possession and mesne profits. The parties reached a consent decree requiring the tenant to vacate and pay enhanced compensation. A dispute arose whether the mesne profits should increase by 10% annually or every two years. The Supreme Court upheld that the tenant must vacate the entire 5,472 sq. ft. property as previously settled, and rectified the consent decree to reflect 10% increases every alternate year, not annually, as this reflected the true compromise. The tenant was ordered to vacate within eight weeks and pay arrears with the corrected calculation.
