HINDUSTAN PETROLEUM CORPORATION LTD vs AJAY BHATIA

Bench: 2 — Indira Banerjee, A.S. Bopanna

In Brief

Hindustan Petroleum Corporation Limited leased two separate petrol pump sites (Plot 4/4 and 4/5) in Delhi from the same landlord family. In 2006, the owner sued only for recovery of Plot 4/4 after the lease expired. The trial court granted possession of Plot 4/4 and mesne profits from July 2003. The High Court modified it to mesne profits from March 2006. During execution, the decree-holder wrongfully took possession of the adjacent Plot 4/5, which was not the subject of the suit. The Supreme Court held that a decree can only be executed against the suit property itself. The Court ordered the executing court to appoint a Local Commissioner to demarcate the exact boundaries of Plot 4/4, and directed restoration of Plot 4/5 and any excess land to the judgment-debtor. Mesne profits must be computed for the suit property only, until actual possession is relinquished.",
