Competent Automobiles Co. Ltd vs Union of India & Ors

Bench: 2 — Kurian

In Brief

This case concerns a challenge to land acquisition proceedings initiated by the Delhi Development Authority (DDA) against Competent Automobiles Co. Ltd under the Land Acquisition Act, 1894. The High Court had upheld the acquisition, but when the case reached the Supreme Court, the DDA filed an affidavit stating that the heavily built-up property—containing religious and historical structures—could not be feasibly acquired without massive demolition and hardship. The DDA decided not to pursue acquisition. The Court accepted this position, set aside the acquisition proceedings, and denotified the land, disposing of the appeal without deciding it on merits while preserving the DDA's right to acquire if circumstances change.
