A bus driver (Mahadeo) was dismissed by Maharashtra State Road Transport Corporation (MSRTC) after a fatal bus accident in 1996. Before the Labour Court, the Corporation claimed Mahadeo drove negligently. However, before the Motor Accidents Claims Tribunal, the Corporation admitted the accident was entirely the lorry driver's fault and played no role in Mahadeo's dismissal. The Supreme Court found the Corporation guilty of fraud on court by suppressing this contradiction and affirmed Mahadeo's wrongful termination. While modifying the High Court's award from 100% to 75% back wages (accounting for his interim daily-wage employment), the Court ordered reinstatement with full terminal benefits and directed payment within three months with interest at 6% p.a., recognizing the Corporation's unfair conduct and violation of natural justice.
