Parminder Singh vs New India Assurance Co. Ltd. & Ors

Bench: 2 — <UNKNOWN>, <UNKNOWN>

In Brief

A motorcyclist permanently disabled in an accident with two trucks sought increased compensation. The Motor Accident Claims Tribunal had computed compensation using notional income because no income evidence was produced, but awarded insufficient medical expenses compensation. The Supreme Court held that when a claimant is permanently incapacitated and unable to work, compensation must adequately cover lifetime care costs. The insurer was directed to create a Demand Draft for the appellant's lifetime medical and care expenses, with the right to recover from the liable truck owners and drivers. The appeal was allowed and pending applications disposed.
