D. Eswara Naidu & Ors vs Special Deputy Collector (L.A)

Bench: 3 — Kurian

In Brief

Appellants claimed enhancement of compensation for pomegranate trees located on land acquired for the Somashila/Telugu Ganga Project. The High Court had fixed compensation at Rs.2,000 per tree. The Supreme Court, noting that the same project had earlier resulted in Rs.3,000 per pomegranate tree being awarded to similarly situated claimants, enhanced the compensation to Rs.3,000 per tree for all appellants. However, the Court denied statutory interest for the period of delay in pursuing legal remedies, as a consequence of the delayed claims.
