This judgment addresses the enhancement of compensation for pomegranate trees acquired under the Land Acquisition Act, 1894 for the Somashila/Telugu Ganga Project. Appellants had been awarded Rs. 2,000 per tree but sought enhancement. The Supreme Court relied on its earlier decision in Civil Appeal Nos. 11404-11405 of 2016, which fixed compensation at Rs. 3,000 per pomegranate tree for the same project. The Court held that similar fairness should apply to all appellants under the project to prevent discrimination, and accordingly enhanced compensation to Rs. 3,000 per tree, but excluded statutory interest for the period of delay in pursuing claims.
