In Brief
The appellant was appointed as a Music Teacher at Samuel LMS High School, Parassala, following direct recruitment. Respondent No. 1 had applied for the same position but was not selected. She later claimed she should have been promoted instead, based on seniority in another school run by the same management. The Kerala High Court accepted her claim, but the Supreme Court allowed the appeal, holding that a candidate who voluntarily participates in a selection process and is unsuccessful cannot thereafter challenge the legality of that recruitment process. Once she applied and participated, she was estopped from raising the objection that direct recruitment was improper.
