Dalip Singh and others, as legal heirs of the original allottee, sought to challenge the resumption of an industrial plot allotted in 1984 to M/s. Shiva Dairy & Oil Mills. The allottees failed to commence construction within the required two-year period or undertake any production for twenty years. After issuing a show-cause notice and giving the allottee opportunity to explain, the Estate Officer resumed the plot under Section 17 of the HUDA Act. The Supreme Court upheld the resumption, holding that industrial plots allotted at concessional rates to promote economic development and employment are subject to strict conditions. The prolonged breach, lack of valid explanation, and failure to remedy the default justified the extreme remedy of resumption. The appeal was dismissed.
