In Brief

A widow and her children inherited their late husband's rights to an industrial plot allotted by Haryana Urban Development Authority (HUDA) in 1984 at concessional rates. The allottee was required to complete construction and commence production within two years but failed to do so for nearly twenty years. After a show-cause notice, HUDA resumed the plot under Section 17 of the HUDA Act, 1977, forfeiting 10% of the consideration money. All lower authorities and the High Court upheld the resumption. The Supreme Court held that resumption was valid as the allottees breached express allotment conditions and defeated the purpose of the industrial policy aimed at economic development and employment generation.
