The appellant, owner of a large property in Bhilwara, sought fixation of standard rent against long-term tenants. The trial court fixed rent at Rs. 5,000 per month; the Additional District Judge enhanced it to Rs. 38,750 per month (Rs. 2.50 per sq. ft.). The High Court, noting the respondents' agreement to vacate, disposed of revision petitions without deciding them on merits, directing only 50% payment. The Supreme Court held that a party's willingness to vacate does not justify a court's refusal to adjudicate substantive rent disputes. The Court set aside the High Court's order and remanded both revision petitions for decision on merits."
