Deepak Kumar & Ors vs Principal Secretary Home, Govt. of U.P Lucknow (U.P) & Ors

Bench: 2 — Kurian

In Brief

Police constables recruited in 2005-06 were terminated in 2007 and later declared wrongfully terminated by the High Court. They sought full back-wages through contempt proceedings, but the High Court declined jurisdiction. The Supreme Court balanced the State's grace in reinstating all employees without further inquiry against the employees' entitlement to continuity of service. Rather than award full back-wages, the Court granted fixed litigation expenses of ₹35,000 per constable as full and final settlement of all claims, and ordered them treated as continuously in service for all purposes except ACP calculation."
