The respondent purchased land in New Delhi after a notice of acquisition was published under the Land Acquisition Act, 1894. The respondent challenged the acquisition before the High Court and succeeded based on an earlier decision that compensation had not been paid. The Supreme Court allowed the appellant's appeal, holding that a subsequent purchaser cannot claim benefit of lapsing acquisition proceedings and that tendering compensation (even through court deposit in exigency) discharges the payment obligation. The High Court's judgment was set aside and the writ petition dismissed.
