A deregulated fruits and vegetable commission agent sought allotment of a shop in Gazipur Mandi after his original market in Phool Mandi, Darya Ganj was de-notified in 1998. The High Court directed mandatory allotment based on his long-pending claim. The Supreme Court clarified that allotment of shops in notified market areas is not a legal right but depends on availability and policy. However, given his claim's long pendency and absence of discrimination, the Court modified the order to allow his case to be considered alongside other eligible applicants for surplus shops within six months, subject to availability and applicable law.
