A fair price shop license was cancelled by a Sub-Divisional Magistrate. The licensee appealed to the Commissioner, whose dismissal order lacked reasoning. The High Court set aside both orders but did not decide the merits. The Supreme Court held that when an appellate court finds an order unreasoned, it must either decide the case on merits itself or remand for a fresh, reasoned decision. Simply setting aside without resolution denies parties their right to a merits decision. The Court remanded to the Commissioner to hear both parties and the State afresh, pass a fully reasoned order addressing all issues, and complete proceedings within three months."
