Delhi Devt. Authority vs Prithi Pal Singh & Ors

Bench: 2 — Kurian

In Brief

Delhi Development Authority acquired land in 1979 for urban development; the first respondent challenged the acquisition for over 30 years. The High Court found no actual physical possession was taken—only a file notation—and remitted the matter. The Supreme Court, invoking Article 142 to end protracted litigation and balance the parties' interests, disposed of the appeals by directing DDA to retain only 3000 square meters and return the remainder to the respondent, with road access guaranteed. No compensation was awarded, and no further claims would be entertained."
