Delhi Administration thr. Secretary, Land and Building Department and Ors vs Gaurav Sahni and Ors

Bench: 2 — Kurian

In Brief

The Delhi Administration sought to acquire land that had been previously acquired but not completed within statutory timelines. The Supreme Court dismissed the appeal, holding that under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013, fresh acquisition proceedings cannot normally be initiated after the statutory period expires. However, considering the peculiar circumstances, the Court granted a one-year grace period to initiate fresh proceedings; if not done, the land must be returned to the original owner.
